Licenses update - please read

Post by jsmcortina »

To announce updated license texts. (12th August 2014)

MS1/Extra - new license file clarifies copyright.
MS2/Extra is unchanged.
MS3 license text updated to include MS3-Pro.

A combined text is available to view/download at http://www.msextra.com/doc/pdf/licenses.pdf

I would like to remind resellers that it is a license condition that a printed copy of the firmware license is included with any products that are supplied with firmware pre-loaded. The PDF sheet is designed to be printed out and included with your shipments.

The licenses are renewed periodically, that date sets an end for the current license documents. Do note that the date would only impacts new sales in any case.

? The source code license is included in the .zip file. From the latest release:

Code: Select all

MS2/Extra source code license - 31 October 2013
===============================================

The MS2/Extra firmware is copyrighted
2003,2004,2005,2006 Bowling and Grippo
2004,2005 Philip L Johnson
2006,2007,2008,2009,2010,2011,2012,2013 James Murray and Kenneth Culver.
2009,2010,2011,2012,2013 Jean Belanger
It is a commercial product. (i.e. it is NOT "open source")

For compiled code (s19) see LICENSE.txt

This license applies to the package of source files that are used to
create the s19 compiled code.

This source code may only be used by owners of official Bowling and
Grippo (B&G) MS2 based products - MS2 (Megasquirt-2) cards; Microsquirt
v1, v2 or v3; Microsquirt module cards.
This license does not give permission to use the "S19" file on other
hardware or to use the "INI" file to tune other hardware.
Nor is it permitted to copy sections of the source code for any non MS2
product.

You are permitted to modify the source code as you wish for use on your
own permitted hardware.

Permission is required from the copyright holders before modified code may
be distributed. The code name and copyright strings presented to the tuning
software title bar must be agreed with the original copyright holders before
a derivative is released. The copyright holders reserve the right to prohibit
development and distribution of any code that is deemed inappropriate
for any reason.

Any addition or modification to the code becomes subject to the present
license. No additional licensing that restricts or expands on the
current license can be applied to the new code or the original code. This
license applies to the code in part or in total.

The modified source code must be readily available to the copyright
holders. (The best way for this is to use the MSEXTRA.com forum
as the main vehicle for distribution even though it can be done
elsewhere in addition.) Support and documentation for modified code
is the sole responsibility of the author of the modifications.

No fitness for purpose or warranty is provided with the code. It is the
sole responsibility of the user to determine whether the code and system
is suitable for their intended application.

It is a condition of this license that you absolve, indemnify and hold
harmless the developers, resellers, manufacturers and distributors from
any liability arising from direct or indirect use of the firmware. Use
of the firmware is entirely at your own risk and liability. If you are
not prepared to accept this, you are not permitted to use the firmware.

MS2/Extra is not designed for use in safety critical systems or
pollution controlled vehicles.

Support and product information can be found via http://www.msextra.com
This license gives the user the right to use this firmware indefinately
on MS2 based products purchased on or before 1st November 2015.

Hi! I'm wondering about licensing when it comes to a very limited run of a redesigned board using the still avaible qfp44 version of the HC908GP32? I designed it simply to use myself, and the board is based on the MS1 v2.2 with a few tweaks such as ground separation and some built-in mods like built in wbo2-controller, spark output and VR-trigger. I usually make my own pcbs, but in this case I was going to have it professionally manufactured since I'm not comfortable making pcbs with qfp-chips due to fine details, plus the manufacturer can do 2mm, 2oz boards. But the manufacturer has a lower limit of five boards, and I would like to sell the remaining boards with pre programmed CPUs to help recover some of the manufacturing cost. I know there has been a ton of work put in to creating MS and I wouldn't want to do this without the permission of the creators.

MS1/Extra is only licensed for use on B&G supplied processors.
